General Terms and Conditions for the training courses offered by VIA GmbH
1. Scope
These General Terms and Conditions apply to all seminars, training courses and further education courses offered by VIA. They are aimed at business people and private participants.
2. Conclusion of contract & online booking
A contract for participation in VIA events is concluded when the participant registers via the VIA website and VIA subsequently confirms participation in writing (by email).
3. Participation in seminars
The seminars are held as face-to-face events.
4. Prices & payment
4.1. The participation fees stated on the VIA website or in the respective seminar description at the time of registration apply.
4.2. All participation fees are gross prices including the applicable statutory value added tax.
4.3. The participation fees are due upon receipt of the invoice.
4.4. Unless otherwise agreed, invoices are generally issued after the event has been booked.
5. Cancellation
5.1. Cancellation of participation is possible free of charge in writing or in text form (e.g. by email) up to 7 days before the start of the event.
5.2. If cancellation occurs within 7 days before the start of the event, VIA Seminare will charge a cancellation fee of EUR 90.00.
5.3. If the registered participant does not show up without prior cancellation, the full participation fee will be charged.
5.4. It is always possible to designate a replacement person for the seminar and to name them in advance.
6. Changes & cancellations
6.1. VIA is entitled to make necessary changes or deviations in terms of content, methodology or organisation before or during the event, provided that these do not significantly impair the benefit of the event for the participant. VIA Seminare is also entitled to replace announced speakers with other speakers of the same professional qualification if necessary (e.g. illness, force majeure).
6.2. VIA reserves the right to cancel events for important reasons, in particular if the number of participants is too low or in circumstances beyond VIA Seminare's control (e.g. sudden illness of the speaker, force majeure). In this case, any participation fees already paid will be refunded. No further claims, in particular for reimbursement of travel or accommodation costs, shall be accepted.
7. Teaching materials
The documents provided during the events are protected by copyright. They may only be used by the participants and within the company for which the participation took place for internal information, qualification and training purposes. Publication, disclosure to third parties or any other use outside this scope is not permitted.
8. Photo and video recordings
By agreeing to these General Terms and Conditions, participants expressly agree that photos and/or video recordings made during the events, in which they may be recognisable, may be used by VIA for advertising, presentation and documentation purposes (e.g. website, social media channels, brochures). The registering companies shall ensure that their participating employees agree to this use.
9. Data protection
Participants have taken note of the data protection information provided separately by VIA.
10. Liability
10.1. VIA shall be liable for damages resulting from intent or gross negligence. In cases of simple negligence, VIA shall only be liable for breaches of essential contractual obligations and limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded.
10.2. VIA accepts no liability for the accuracy, timeliness and completeness of the event documents, presentations or other content provided in the context of the event.
10.3. The above limitations of liability do not apply to damages resulting from injury to life, limb or health.
11. Final provisions
11.1. The place of jurisdiction is Mainz.
11.2. The contract concluded between the contractor and the client, including these General Terms and Conditions, remains binding in its remaining parts even if individual points are legally invalid.
